Please read these terms and conditions carefully, as by making a booking you agree to accept them.

They form, together with the information detailed in the itinerary, a part of the contract you enter into with Zomya Adventures when you book a trip.

They apply to all events offered by Zomya Adventures unless otherwise specified in the contract.


§1 General

Some of our trips can be challenging. Therefore, Travelers are obliged to be fit and well-prepared on departure. Contact Zomya Adventures for information about requirements for your trip. We reserve the right to refuse participants who do not meet the necessary fitness standard, technical or mental requirements.

Our planned routes can be affected by natural conditions, this requires flexibility and, exceptionally, might require us to make changes in the itinerary. If possible, Zomya Adventures will inform Travelers of this in advance.

As a Traveler, you must accept that you participate at your own risk. Zomya Adventures tour guides have experience of the destinations, and their instructions must be obeyed. The tour guides or Zomya Adventures cannot be held responsible for any accidents or discomfort that may occur.

If unexpected situations arise after the trip has started, Travelers are obliged to comply with the new trip arrangements. Any additional costs incurred in such cases, for example for new tickets, transport costs, board and lodging must be covered by the Travelers themselves.


§2 Booking

Zomya Adventures trips must be booked by email, and the booking is binding. Failure to pay the amount on time is deemed to constitute a material breach of contract and entitles Zomya Adventures to cancel the booking, but our deposit claim does not lapse in the event of such cancellation.


§3 Payment

Upon booking, a 50% deposit should be paid to secure the reservation.

The balance payment is required 60 days before the departure date.

All payments must be paid in full at the time of transaction. An exact amount is required and it is the Traveler’s responsibility to bear any bank charges incurred (including third party bank charges).

Zomya Adventures reserves the right to cancel the booked arrangement without refund to the Traveler if full payment is not made in a timely manner.

Payments may be made by bank transfer, or credit card via our Payoneer account.


§4 Prices

All prices are quoted in Chinese Yuan (Renminbi) unless otherwise indicated. Prices do not include ancillary fees. Passport and visa fees, some departure taxes, gratuities (tips), meals, beverages, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included except otherwise remarked.


§5 Cutomer Responsibilities

5.1. Travel Insurance: Zomya Adventures highly recommends the purchase of travel insurance, including trip cancellation insurance. Baggage insurance is also recommended. Under no circumstances will Zomya Adventures be liable for any consequence/loss due to the Customer not being covered by insurance.

5.2. Passports, Visas, Travel Documents: It is the Traveler’s responsibility to ensure all passports and/or visas and/or necessary travel documents are prepared and valid for travel at departure, remains valid for a minimum of six months beyond the return travel date. It is the Traveler’s responsibility to check that the travel documents received agree with the booking. Zomya Adventures under no circumstances is liable for any consequences/loss due to the Traveler not having the required passport, visa, and/or travel documents.

5.3. Vaccinations: It is the Traveler’s responsibility to ascertain whether any vaccinations or other health precautions are needed beforehand.

5.4. During the trip: Travelers must comply with the tour guides' instructions, directions and orders during the trip. Travelers are also obliged to comply with the rules and regulations stipulated by the local authorities, tour operator or the tour operator's representatives, including any rules of conduct stipulated by individual hotels, etc.

Travelers must not act in such a manner that they are a nuisance to fellow travelers.

If Travelers grossly neglect their responsibilities and obligations, they may be denied participation in or excluded from the rest of the trip without being entitled to a refund from the tour operator. If Travelers are excluded after starting the trip, they may have to cover the costs of their return journey. they can be held liable in damages if they, intentionally or negligently, inflict a loss on the tour operator, for example by not complying with the rules and regulations mentioned above.

Zomya Adventures accepts no liability for loss or inconvenience caused by neglect on the part of the Traveler.

6.1 Itinerary changes: If the Traveler wishes to make changes to an existing booking, an administrative fee of RMB 500 will be charged, providing that the booking can be changed.


§6 Zomya Adventure Responsibilities

6.1. Itineray: Zomya Adventures undertakes to carry out an agreed program with itinerary and content as described in the trip description distributed. However, this obligation is subject to changes and circumstances outside of our control.

6.2. Group Size: In case of group trips, the minimum group size is specified in the trip description. If we do not meet the minimum group size, Zomya Adventures can often still run the trip at a small additional charge. If the additional charge exceeds 10 % of the total cost of the trip, Travelers are entitled to cancel the trip and receive a refund. If Zomya Adventures has to cancel the trip, travelers will be informed of this no later than 30 days before the departure date. The participants shall receive a full refund of the amount payed to Zomya Adventures.

6.3. Price: Exceptionally, Zomya Adventures reserves the right to adjust prices in accordance with changes in the underlying tour costs and governmental taxes. If the price increases by more than 10 %, the Traveler is entitled to withdraw from the contract.


§7 Cancellations & Refund

The Traveler must notify Zomya Adventures in writing (by mail or email) of any cancellation. Cancellations are effective on the day received by Zomya Adventures. If a deadline for cancellation falls on a public holiday, any cancellations must be received on the preceding working day. Traveler’s payment to Zomya Adventures will be refunded, less a cancellation fee, in an amount that depends on when we receive your notice as follows:

- No show:                        no refund

- Less than 30 days before departure: no refund

- 30 - 59 days before departure:    50% of amount paid

- 60 days or more before departure:  75% of amount paid
